Hold Harmless Agreement and Liability Release Form (International Missions)
SOLT Missions understands that the proposed SOLT Missionary Volunteer year or international/domestic SOLT run program may potentially involve certain unavoidable risks. While these risks are real, they are rare. It is our intent to minimize every risk that might impact you and yet simultaneously acknowledge that in in a foreign context we do not control the sanitation, the laws, or the degree to which laws are enforced, and must therefore recognize a certain element of risk. These risks include but are not limited to those involved in traveling to and within, and returning from a foreign country; foreign political, legal, social, and economic conditions; different standards of design, safety and maintenance of buildings, public places and conveyances; local medical and weather conditions. Additional risks may also include automobile accidents, contagious diseases, food poisoning, falls, airline accidents, strikes, military or political activity, equipment failure, assault, battery, robbery, injury, and death. You are encouraged to make your our own investigation and be willing to accept these risks. SOLT has also investigated the particular risks that may be present in the area of our destination, but you must understand that many of these risks are unpredictable, are wholly outside the control of SOLT, and may change and increase beyond what is now known, anticipated or expected. Additionally, because of the nature of our mission, although we monitor US Department of State Travel Warnings and Advisories, we also do not limit trips solely based on a particular State Department Travel Warning and/or Advisory. SOLT also encourages you to refer to the Center for Disease Control (www.cdc.gov) and your healthcare provider for professional recommendations about immunizations, disease prevention, and necessary medications for areas in which you will be traveling. Knowing the risks described here, and in consideration of being permitted to participate in this travel, you are asked to assume all the risks and responsibilities surrounding your participation in this travel. Be aware that foreign countries have their own laws and standards of acceptable conduct, including dress, manners, morals, politics, and behavior. Please recognize that behavior that violates those laws or standards could do harm to SOLT relationships with institutions therein, as well as your health and safety. You will be informed of, and must abide by, all such laws and standards for the country of your destination. Should problems arise, you may be required to attend to any legal problems you encounter with any foreign nationals or the government of that country. SOLT is not responsible for providing assistance under these circumstances.
I, having read and understood the risks described herein and in consideration of being permitted to participate in this mission year, agree to assume all the risks and responsibilities surrounding my participation in this mission year. Also I, to the maximum extent permitted by law, do voluntarily and without reservation, release, hold harmless, save, protect and indemnify THE SOCIETY OF OUR LADY OF THE MOST HOLY TRINITY (SOLT), and their respective officers, employees and agents, from and against any present or future claims, damages, expenses, actions, losses or liability of whatever kind including but not limited to injury to my person, injury to my property, or injury for which I may be liable to any other person, whomsoever and whatsoever, relating in any way to my travel with SOLT, arising out of or from any accident or other occurrence causing injury to any person or property caused by the negligence or other actions of SOLT or any other party including the risks discussed and assumed in this Agreement and in the Individual. I further agree that:
Before my departure, I will provide SOLT with complete and accurate physical and mental health information as well as any personal data that may be necessary for SOLT to arrange a safe and healthy trip experience for myself and other participants. I understand that SOLT does not discriminate on the basis of any physical or mental disability; however, information regarding such disabilities is necessary for making reasonable accommodations.
I assume full responsibility for my care and safety during my participation in the Mission.
I assume full responsibility for my own official international travel documents such as passports and visas. I also assume full responsibility for familiarizing myself and abiding by entry and exit requirements for foreign countries including but not limited to passport validity, common and special visa requirements, regulations for allowable or prohibited goods and items to be transported internationally. I acknowledge that SOLT holds no responsibility for denial of visa, denial of foreign entry, denial of passport or any other anomaly (including loss of documents) that affects any portion of travel for the trip. It is my responsibility to follow all relevant immigration regulations of the host country.
I will inform myself of the local conditions, customs and laws of the mission site that may present health, safety or legal risks. Moreover, I will promptly report to my SOLT Mission Director any health, safety or legal concerns while abroad.
If I leave the Mission prior to its completion, SOLT has no liability to provide or arrange for transportation, housing, dining or other services to me in connection with my early departure.
I will comply with all rules and regulations issued by SOLT, the host institution and the host nation including, but not limited to the following.
a.) I will not buy, sell or use illegal drugs at any time;
b.) I will not engage in the use of alcohol except at the discretion of the Mission Director when in accord with local customs and laws.
c.) If I violate any rule, regulation or requirement, I understand that I may be sent home at my own expense.
I understand that I may be prevented from participation in a trip at any point at the discretion of SOLT.
SOLT may, at its discretion, determine what circumstances within the host country may require the cancellation of the Mission. SOLT will provide me with as much advance notice as possible of such a decision. I also understand that the SOLT mission we are visiting or the host government may prematurely terminate the trip. In the event, SOLT will provide me with assistance in arranging transportation back to the United States, at my expense. However, SOLT bears no liability for any loss or claims incurred by me resulting from a termination of the Mission. SOLT is not obligated to provide any refund for cancelled or re-routed trips. If I choose to remain in the host country after receiving notice of the program’s termination, I bear complete responsibility and liability for my own care and safety.
I authorize SOLT to contact my parents or other family members in the case of an emergency or when SOLT deems it necessary. I will submit parental contact information before my departure. I also grant SOLT the authority during the Mission to arrange for necessary emergency medical treatment, if a family member cannot be reached.
If needed for health reasons, and I am incapacitated, I give permission to SOLT (and thereby to its employees accompanying me on the Mission) to direct any evaluation, diagnosis, or treatment (including the administration of medication or other forms of treatment) in accordance with medical practice as recommended by licensed medical personnel. I relieve SOLT of all responsibility and consequences that may arise as a result of this treatment. I will not hold SOLT liable in the event of injury. Further, I agree to accept any and all financial responsibility as a result of scheduling medical treatment.
I have read and understand this entire Agreement and agree to all its terms and provisions.
